If your business is based in Kota, Baran, Bundi, or Jhalawar and you are struggling with unpaid invoices, the MSME Facilitation Council (MSEFC) Kota is the primary forum for your legal redressal.
As a practicing Advocate in Kota, I provide end-to-end legal assistance—from filing applications on the MSME Samadhaan Portal to representing your interests during Council hearings and executing final Awards.
The Council at Kota acts as an arbitrator for local industries. Under the MSMED Act 2006, you are entitled to:
Mandatory Interest: Payment of compound interest at 3x the RBI Bank Rate.
Time-Bound Disposal: Cases are ideally decided within 90 days.
Local Jurisdiction: No need to travel to Jaipur or Delhi if your unit is registered under the jurisdiction of the Kota District Industries Centre (DIC).
We assist you in filing a digital application. Udyam Registration is a prerequisite. Once filed, the buyer is notified, often leading to a settlement before the case even reaches the Council.
The Council first attempts to settle the matter through conciliation. If the buyer agrees to pay, a settlement deed is signed.
If conciliation fails, the Council takes up the matter for arbitration (or refers it to an institute). As your MSME Advocate in Kota, I present your arguments, prove the "Acceptance of Goods," and counter any claims of "Quality Rejection" made by the buyer.
Once the Council passes an "Award" (judgment), it has the same force as a Civil Court decree. We then move for Execution under Section 36 of the Arbitration Act to recover your money through the attachment of the buyer’s assets if necessary.
The Council meetings are chaired by the Director/General Manager of the District Industries Centre.
Location: District Industries Centre (DIC), DCM Road, Kota.
